Be aware of your funder's requirements
When you receive funding, your contract may impose a number of obligations on you regarding the dissemination of your research data, source code, and software.
Public funders' requirements
One of the objectives of public research is to ensure that the results of funded research are disseminated as widely as possible.
To this end, several funding agencies, including the French National Research Agency (ANR), signed a joint declaration in support of open science in 2020. They require open access to publications and the drafting of a data management plan for each funded project, and are committed to encouraging the opening up of associated data. The European Commission also requires compliance with a number of obligations related to open science.
Since 2019, the ANR has required the drafting of a data management plan (DMP), which must be submitted to your personal space on the ANR website within the first six months of the research project and then updated throughout the project.
Depending on the nature of the project and the software developed, it is also possible to create a software management plan or add your software as a production in your DMP.
To help with the drafting of the DMP, the ANR provides a DMP template available on the DMP OPIDoR platform.
In this new European funding programme, there is a strong emphasis on data management: beneficiaries must manage the digital research data generated as part of the action in a responsible manner, in accordance with the FAIR principles and by taking the following measures:
-1- The European Commission requires project leaders to draw up a data management plan (DMP), which must be uploaded to the Participant Portal in accordance with the following timetable:
- an initial version of the DMP within the first 6 months of the research project
- an updated intermediate version for the mid-term evaluation
- the complete final version at the end of the project

-2- Data must be deposited in a trusted data repository:
- As quickly as possible
- In the manner specified in the DMP
- In open access, under a CC-BY licence or equivalent, unless free access to the data:
- would be contrary to the legitimate interests of the beneficiary, including commercial exploitation, or
- would be contrary to any other constraint, in particular the competitive interests of the EU or the obligations of the beneficiary.
- If some or all of the data cannot be made freely available, this must be justified in the DMP.
- For some actions, data must be deposited in a federated repository within the European Open Science Cloud (EOSC).
-3- The metadata of the deposited data must:
- be open under Creative Commons Public Domain Dedication (CC 0) or equivalent
- comply with the FAIR principles
- provide information on at least the following elements: datasets (description, date of deposit, author(s), location and embargo); Horizon Europe or Euratom funding; name of the funded project, acronym and number; licence conditions; persistent identifiers for the dataset, the authors involved in the action and, if possible, for their organisations and the grant.
- Where appropriate, metadata should include persistent identifiers for publications and other related research outputs.
Note: Costs associated with data management are eligible for reimbursement.
Requirements of other private funders
Good management of your data, source code and software is independent of the type of funding. If more than 50% of your funding comes from private sources, certain conditions may apply regarding dissemination with restricted access.
Research data management must therefore be carefully considered, with openness being the general principle and closure the exception. The decision to keep data closed must be based on grounds arising from other legal provisions that constitute exceptions to the general principle of openness.
